Jared Karstetter worked for labor organizations representing King County, Washington corrections officers for over 20 years. In 1987, Karstetter began working directly for the King County Corrections Officers Guild (Guild). Throughout his employment with the Guild, Karstetter operated under successive 5-year contracts that provided for just cause termination. Eventually, Karstetter formed his own law firm and worked primarily for the Guild. He offered services to at least one other client. His employment contracts remained substantially the same. Karstetter's wife, Julie, also worked for the Guild as Karstetter's office assistant. In 2016, the King County ombudsman's office contacted Karstetter regarding a whistleblower complaint concerning parking reimbursements to Guild members. The Guild's vice-president directed Karstetter to cooperate with the investigation. The Guild sought advice from an outside law firm, which advised the Guild to immediately terminate Karstetter. In April 2016, the Guild took this advice and, without providing the remedial options listed in his contract, fired Karstetter. In response, Karstetter and his wife filed suit against the Guild, alleging, among other things, breach of contract and wrongful discharge in violation of public policy. The Guild moved to dismiss the suit for failure to state a claim. The trial court partially granted the motion but allowed Karstetter's claims for breach of contract and wrongful termination to proceed. On interlocutory review, the Court of Appeals reversed and remanded the case, directing the trial court to dismiss Karstetter's remaining breach of contract and wrongful termination claims. The Washington Supreme Court found that “the evolution in legal practice has uniquely affected the in-house attorney employee and generated unique legal and ethical questions unlike anything contemplated by our Rules of Professional Conduct (RPCs).” In this case, the Court found in-house employee attorneys should be treated differently from traditional private practice lawyers under the RPCs. “Solely in the narrow context of in-house employee attorneys, contract and wrongful discharge suits are available, provided these suits can be brought without violence to the integrity of the attorney-client relationship.”Karstetter alleged legally cognizable claims and pleaded sufficient facts to overcome a CR 12(b)(6) motion of dismissal. This matter involved two unrelated juveniles, E.H. and S.K.-P. in unrelated dependency proceedings. R.R., E.H.;s mother, and S.K.-P. both challenged the validity of RCW 13.34.100's discretionary standard for appointment of counsel for children in dependency proceedings, and sought instead a categorical right to counsel for all children in dependency proceedings. The Washington Supreme Court consolidate these cases to address that issue. The Supreme Court determined RCW 13.34.100(7)(a) was adequate under the Washington Constitution, and that the trial court did not abuse its discretion in denying a motion to appoint counsel. In light of GR 15, the Supreme Court held confidential juvenile court records remain sealed and confidential on appeal, and granted a joint motion to seal records in these matters. This case concerned a recent law school graduate's application to sit for the Washington State Bar Examination. Tarra Denelle Simmons had a history involving long-term substance abuse, multiple criminal convictions, and two bankruptcies. However, in the approximately five and a half years preceding her application to sit for the bar exam, Simmons successfully engaged in treatment for her substance abuse and childhood trauma. She maintained her sobriety since September 2011 and was not accused of any criminal or unethical behavior since then. The Washington Supreme Court found Simmons was entirely candid about her past when she applied to sit for the summer 2017 bar exam, and she readily provided further information as requested by counsel for the Washington State Bar Association (WSBA). Bar counsel referred Simmons' application to the WSBA Character and Fitness Board (Board), which recommended by a vote of six to three that Simmons' application be denied. The Supreme Court then reviewed her application and the Board's recommendation, heard oral argument, and granted Simmons' application in a unanimous order later that day. This case presented for the Washington Supreme Court's review claims of breaches of fiduciary duty and legal malpractice against lawyers hired to defend insureds in a civil action where the insurance company provided the defense. The insureds claimed the lawyers failed to disclose potential conflicts of interest based on long-standing relationships the law firm had with the insurance company in not only accepting cases representing insureds in other civil cases, but also representing the insurance company itself in coverage disputes. The insureds also claimed the attorneys failed to advise them of settlement negotiations, and by taking settlement directions from the insurer. The trial court granted summary judgment in favor of the lawyers, finding the insureds failed to establish an actionable breach. The Court of Appeals affirmed. Former clients sued their attorneys for legal malpractice based, in part, on the attorneys' withdrawal from a prior ease. But the attorneys obtained that withdrawal by court order. In the original case, the former clients appealed the court's order approving withdrawal, and that appeal was rejected. The attorneys thus argued collateral estoppel applied to bar a malpractice action based on their withdrawal. The Washington Supreme Court agreed: withdrawal by court order in an earlier proceeding was dispositive in a later malpractice suit against the attorney. Although other malpractice complaints unrelated to the withdrawal would not be precluded, a client cannot relitigate whether the attorney's withdrawal was proper. “If we are to have rules permitting attorney withdrawal, we must allow attorneys to have confidence in those rules.” View "Schibel v. Rachelle and Charles Black were married for nearly 20 years and had three sons. They raised their children in a conservative Christian church and sent them to private, Christian schools. In 2011, Rachelle told Charles that she was lesbian, and the parties divorces shortly thereafter. In the order of dissolution, the trial court designated Charles as the primary residential parent. The final parenting plan also awarded Charles sole decision-making authority regarding the children's education and religious upbringing. The record showed that the trial court considered Rachelle's sexual orientation as a factor when it fashioned the final parenting plan. Furthermore, the Supreme Court found improper bias influenced the proceedings. “This bias casts doubt on the trial court's entire ruling, and we are not confident the trial court ensured a fair proceeding by maintaining a neutral attitude regarding Rachelle's sexual orientation. Highland High School quarterback Matthew Newman suffered a permanent brain injury at a football game in 2009, one day after he allegedly sustained a head injury at football practice. Three years later, Newman and his parents (collectively Newman) sued Highland School District No. 203 (Highland) for negligence. Before trial, Highland's counsel interviewed several former coaches and appeared on their behalf at their depositions. Newman moved to disqualify Highland's counsel, asserting a conflict of interest. The superior court denied the motion but ruled that Highland's counsel "may not represent non-employee witness[es] in the future." Newman then sought discovery concerning communications between Highland and the former coaches during time periods when the former coaches were unrepresented by Highland's counsel. Highland moved for a protective order, arguing its attorney-client privilege shielded counsel's communications with the former coaches. The trial court denied the motion, and Highland appealed. At issue was whether postemployment communications between former employees and corporate counsel should have been treated the same as communications with current employees for purposes of applying the corporate attorney-client privilege. After review of the specific facts of this case, the Washington Supreme Court held that the privilege does not broadly shield counsel's postemployment communications with former employees. The complaint in this case alleged negligence based on a failure to schedule a resentencing hearing for a criminal defendant after the Court of Appeals remanded for resentencing. Consequently, the defendant served more prison time than he otherwise would have had he been promptly resentenced. The issue this case presented for the Washington Supreme Court's review centered on whether the "actual innocence" element of a criminal malpractice claim against the trial attorney, the appellate attorney and King County (through its agency, the Department of Public Defense), applied to the facts of this case to bar the complaint. The Supreme Court held that actual innocence was a necessary requirement to pursue the criminal malpractice claim and that no exception applied. Jared Barton sued Korrine Linvog, her parents Thomas and Madonna Linvog, and the State. Barton reached a settlement with the Linvogs through which the Linvogs agreed to advance Barton money in exchange for his promise not to execute a judgment against them above their insurance policy limits. Neither Barton nor the Linvogs disclosed this settlement to the court or to the State. After a jury trial, Barton was awarded $3.6 million, and the trial court entered judgment against the State and the Linvogs. In the process of paying the judgment, the State discovered the agreement. The State then moved to vacate the judgment on grounds of fraud and misrepresentation. The trial court denied the motion but sanctioned Barton's attorney for failing to disclose the terms of the agreement. Barton's attorney appealed the sanction. Finding no abuse of discretion in its sanction against Barton's attorney, the Supreme Court affirmed. View "Barton v. Dep't of Transp." on Justia Law
