Thompson-Widmer v. Larson, et al.
Carrie Thompson-Widmer appealed the dismissal of her claims of defamation and tortious interference with a business relationship against Kimberly Larson, Wells County, Eddy County, and Foster County. In January 2017, Larson filed a formal complaint with the State Board of Social Work Examiners against Thompson-Widmer on the basis of Thompson-Widmer’s actions in two child protection services cases. Larson alleged Thompson-Widmer misrepresented information about a child’s home environment in one case, and altered a report about methamphetamine in an infant’s meconium in the other case. Larson also met with a state’s attorney about Thompson-Widmer’s actions. The attorney referred the matter to a special prosecutor for consideration of potential criminal charges. Because the complaint to the State Board was filed while Thompson-Widmer was a Tri-County employee, Larson placed the complaint and the supporting documents in Thompson-Widmer’s employee personnel file. After the criminal investigation into Thompson-Widmer’s action was suspended, she became employed with Catholic Charities in April 2017. Tri-County worked with Catholic Charities on adoption placement cases. Larson’s staff informed her they did not feel comfortable working with Thompson- Widmer. Larson notified Catholic Charities that Tri-County would rather work with someone other than Thompson-Widmer. Catholic Charities submitted an open records request for Thompson-Widmer’s personnel file, and Larson fulfilled the request on Tri-County’s behalf. In May 2017, after receiving the personnel file, which included Larson’s complaint against Thompson-Widmer, Thompson-Widmer was terminated because she was not forthcoming about her issues while employed by Tri-County. After review, the North Dakota Supreme Court affirmed, concluding Larson’s communications were privileged and therefore not subject to liability for defamation. View "Thompson-Widmer v. Rembert v. A Plus Home Health Care Agency, LLC
Rembert, a nurse, routinely worked more than 40 hours per week for A Plus but did not receive overtime. Rembert filed a purported class action under the Fair Labor Standards Act (FLSA). The Department of Labor investigated. The court certified a class and ordered A-Plus to provide a list of persons potentially fitting within the class. The deadline passed. A magistrate scheduled a phone conference; defense counsel failed to appear. A Plus provided responsive information about five weeks after the deadline. The parties began discovery, which was notable for defense counsel’s repeated failure to comply. Rembert’s counsel finally filed a motion to compel. The magistrate granted the motion and ordered A Plus to pay “reasonable attorneys’ fees and costs.” Defense counsel failed to respond. Rembert filed another motion. As a result of the DOL investigation, some class members received full payment of the amounts owed to them. The parties ultimately agreed to the entry of judgment in favor of Rembert and the remaining class members, $18,961.Rembert moved for an award of fees and costs under the FLSA, 29 U.S.C. 216(b). Her lawyers requested hourly rates of $350 and $300, respectively, and submitted detailed records for 21.2 hours of work for the motion to compel and 98.7 hours on the remainder of the case. The court approved the rates but reduced counsel’s total compensable hours to 46.2 and cut the fee award an additional $1,660. The Sixth Circuit reversed. The plaintiffs obtained 100% of the recovery due to them. The court did not explain which hours it rejected and apparently did not consider the impact of delays caused by defense counsel. Big Lots Stores v. Super. Ct.
In this case, the real parties in interest and plaintiffs were former store managers for petitioner-defendant Big Lots Inc., who claimed they spent less than 50 percent of their worktime on managerial tasks and, as a result, should have been paid overtime compensation for hours worked in excess of a standard 40-hour week. Big Lots was an Ohio corporation. When this lawsuit was first filed, it retained a California law firm, Haight Brown & Bonesteel LLP (Haight Brown), as counsel of record. Big Lots later sought the superior court’s permission for attorneys from an Ohio law firm, Vorys, Sater, Seymour & Pease LLP (Vorys), to also represent it. The trial judge ultimately granted applications filed by three different attorneys in the Vorys firm. But after later being advised that these Ohio attorneys were attempting to represent various current and former Big Lots managers in depositions noticed by plaintiffs, the court revoked pro hac vice authorization for all three lawyers. Big Lots petitioned for a writ of mandamus to overturn that order. The Court of Appeal agreed with the trial judge that there was a between an attorney’s representation of the defendant corporation in a lawsuit and his or her representation of current or former employee witnesses. "Pro hac vice admission as to one client does not necessarily allow a lawyer to represent a different client even if substantive law does not otherwise prohibit it." The Court nonetheless concluded the total revocation of pro hac vice status for the Vorys attorneys was not supported by the record then before the trial court. The petition to vacated the revocation order was granted, but the matter was returned to the trial court for additional hearings/orders deemed necessary. View "Big Lots Stores v. Super. Zander v. Carlson
Fox Lake patrol officer Zander was charged with misconduct arising from multiple job-related incidents. The chief recommended termination. Zander's union, FOP, assigned Attorney Carlson, an FOP employee. Zander had no input into the choice of an attorney, had no retainer agreement with Carlson, and was not charged for Carlson’s services. Under the Illinois Municipal Code (65 ILCS 5/1-1-1), police officers who face removal or discharge are entitled to a hearing before the local board of fire and police commissioners unless a collective bargaining agreement (CBA) provides for arbitration. The CBA between Fox Lake and FOP gave officers the option of pursuing either avenue. On Carlson’s advice, Zander chose arbitration. The arbitrator upheld the termination. Zander sued, alleging legal malpractice and that FOP has no right to employ attorneys to furnish legal services under its direction to FOP members, and cannot control what attorneys assigned to help FOP members may do and “should be vicariously liable.”The circuit court dismissed, citing the U.S. Supreme Court’s "Atkinson" holding, which immunizes union members and officers against personal liability for actions taken while acting as a union representative in the context of the collective bargaining process. The court noted the parallels between federal labor law and the Illinois Public Labor Relations Act. The Illinois Supreme Court agreed. But for the collective bargaining agreement. FOP would have owed Zander no duty. Zander’s claim against the union fell within the exclusive jurisdiction of the Illinois Labor Relations Board. View "Zander v. Carlson" on Justia Law
Alemarah v. General Motors, LLC
Alemarah sued her former employer, GM, in both state and federal court, claiming employment discrimination based upon identical factual allegations. The state suit asserted state claims, the federal suit, federal claims. The state court dismissed that case after a case evaluation ($400,000); the federal district court granted GM summary judgment. Alemarah challenged the court’s grant of summary judgment, its denial of her motion to recuse the judge, and an award ($4,715) of costs.The Sixth Circuit affirmed. The court properly granted summary judgment. Under Michigan law, the state court’s order dismissing her claims after acceptance of the case evaluation was a judgment on the merits, Alemarah and GM were parties in both case, and the matter in the second case could have been resolved in the first, so res judicata bars every claim arising from the same transaction that the parties, exercising reasonable diligence, could have raised. The court acknowledged that a reasonable observer could conclude that the district judge’s statement in a letter to Alemarah’s counsel expressed anger and another of the judge’s actions could be seen as punitive but those actions were not “so extreme as to display clear inability to render fair judgment.” GM submitted as costs the amount it paid for deposition transcripts that it attached to its summary judgment motion; the costs were allowable. Stockdale v. Helper
Williamson County District Attorney Helper told other officials that she distrusted Fairview Police officers Stockdale and Dunning and that she would not “take their cases.” Helper wrote to the city manager (Collins): “per our discussion, this Office has concerns about reports initiated/investigated solely by” Dunning or Stockdale and that defense counsel would be entitled to a copy of an earlier investigation report concerning the officers. Helper stated, “[w]ithout independent corroboration from another law enforcement officer and/or independent witness, the[ir] testimony . . . may be impeached.” Collins disputed Helper’s assessment but Helper refused to back down. Collins fired the officers, explaining the email provided the “sole reason.”Stockdale and Dunning sued. They settled their claims against the city, leaving a First Amendment claim and state law claims against Helper. The district court denied Helper’s claim of absolute immunity and her claim for qualified immunity from the federal First Amendment retaliation claim. It also denied her summary judgment with respect to state law claims for official oppression and tortious interference with a business relationship. The Sixth Circuit affirmed in part. Because Helper’s actions were not closely tied to the judicial process, absolute immunity does not apply; because her conduct did not violate any clearly established law, qualified immunity protects her. Cartwright v. Silver Cross Hospital
In 2015, Cartwright sued his former employer, alleging discrimination based on his race and sex under Title VII, 42 U.S.C. 2000e; discrimination based on race, 42 U.S.C. 1981; and age discrimination, 29 U.S.C. 623. The judge appointed counsel for the limited purpose of settlement negotiations. The parties did not reach an agreement. The attorney was relieved of the limited representation. Cartwright failed to respond to discovery requests and filed many motions. The judge recruited a lawyer to represent him pro bono but later permitted the attorney to withdraw. The judge recruited another pro bono lawyer. After 14 months and more than 530 hours of work, the third attorney moved to withdraw citing substantial, irreconcilable disagreements with Cartwright. The judge granted the defendants partial summary judgment. Cartwright responded with multiple motions, accusing the judge of bias. The defendants moved to dismiss the case with prejudice for failure to prosecute. The judge recruited another pro bono attorney, then denied the motion as moot. Counsel later was allowed to withdraw. After four years and repeated warnings, the judge dismissed the case. The Seventh Circuit affirmed, reminding "judges that they need not and should not recruit volunteer lawyers for civil claimants who won’t cooperate ... Pro bono representation of indigent civil litigants is a venerable tradition ... courts must be careful stewards of this limited resource.” View "Cartwright v. Silver Cross Hospital" on Justia Law
Parsons v. Walters
Vernon Walters was injured in a work-related incident in October 2006; the vehicle he was driving was struck by an oncoming train. After receiving workers’ compensation benefits, he and his wife, Donyell Walters, filed a third-party claim against the company operating the train involved in the collision, Kansas City Southern Railway Company (KCSR). The Walterses hired the Parsons Law Firm to represent them in their suit, and Tadd Parsons took the case. The Walterses’ lawsuit against KCSR was ultimately dismissed with prejudice in September 2010 for, among other reasons, failure to prosecute, failure to comply with discovery obligations and fraud upon the court. Tadd never told the Walterses that their case had been dismissed and led them to believe their case was ongoing. Three years after the case had been dismissed, Tadd admitted he fabricated a settlement offer from KCSR in the amount of $104,000 and advised the Walterses to accept the offer, which they did. When eight months passed after Tadd informed the Walterses about the fabricated settlement, the Walterses demanded to meet with Jack Parsons, the other general partner at the Parsons Law Firm. Jack offered the Walterses $50,000 to settle any claims they may have had against Tadd based on his conduct in representing them in the KCSR lawsuit. The Walterses refused Jack’s offer and then filed a claim against Tadd, Jack and the Parsons Law Firm, alleging claims of fraud, defamation, negligent representation, negligent and intentional infliction of emotional distress and punitive damages. The trial court granted partial summary judgment for the Walterses on the matter of liability, finding that Tadd and the Parsons Law Firm were liable for fraud and intentional infliction of emotional distress. The court then held a jury trial on damages. The jury verdict awarded the Walterses $2,850,002 in compensatory damages, which exceeded what the Walterses had demanded in compensatory damages in their complaint and in their motion to set damages. Finding the jury’s verdict shocked the conscience, the court remitted the damages to $1,034,666.67 in a second amended final judgment. Parsons appealed to the Mississippi Supreme Court, and the Walterses cross-appealed. The Supreme Court determined the trial court did not abuse its discretion by excluding irrelevant evidence about the underlying KCSR lawsuit because the value of the lawsuit had no bearing on the damages the Walterses sustained due to Tadd Parsons’s and the Parsons Law Firm’s fraud and IIED. Further, the Court determined the remitted verdict’s award of damages was excessive and not supported by substantial evidence. The trial court was therefore affirmed in part, reversed in part, and the matter remanded for a new trial on damages. View "Parsons v. Walters" on Justia Law
Betancourt v. OS Restaurant Services, LLC
The Court of Appeal held that the trial court abused its discretion in awarding any attorney fees to plaintiff. Labor Code section 218.5 mandates an attorney fee award in any action brought for the nonpayment of wages, if any party requests them at the initiation of the action. Furthermore, Kirby v. Immoos Fire Protection, Inc. (2012) 53 Cal.4th 1244, 1255, held that a plaintiff cannot obtain attorney fees in an action for failure to provide rest breaks or meal periods. In this case, there was no basis for the trial court's award of fees where the only wage and hour claims alleged and litigated were for rest break and meal period violations.The court held that plaintiff's claim that it must affirm the judgment because defendants presented an inadequate record for judicial review is unfounded. The court also rejected plaintiff's contention that the predicate misconduct of her wage and hour claims was not rest period violations, but rather failure to pay earned wages. The court explained that this theory was reflected nowhere in the record of the attorney fee proceedings—until plaintiff filed her reply papers. In those reply papers, plaintiff cited no evidence of any work performed before the settlement that referred to or suggested the existence of a claim or cause of action for failure to pay earned wages. Accordingly, the court reversed the judgment to the extent it awarded attorney fees to plaintiff, remanding for entry of a new and different judgment denying recovery of attorney fees. Primera Beef v. Ward
Primera Beef, LLC appealed a district court’s grant of summary judgment in favor of Allan Ward. Primera Beef alleged Ward breached the confidentiality provision of a settlement agreement between him and Primera Beef when Ward’s attorney disclosed the terms of the agreement to a prosecutor in a related criminal action. Ward moved for summary judgment, arguing that he was not liable for his attorney’s actions because his attorney was not acting within the scope of his authority when he disclosed the terms. The district court agreed. The Idaho Supreme Court concurred and affirmed the district court. View "Primera Beef v. Ward" on Justia Law
