In 2017, a grand jury indicted Ryan Duke for malice murder and related offenses in connection with the October 2005 death of Tara Grinstead. For approximately 17 months, Duke was represented by a public defender from the Tifton Judicial Circuit’s Public Defender’s Office. Then, in August 2018, Duke’s public defender withdrew from representation and John Merchant and Ashleigh Merchant filed an entry of appearance, indicating that they were representing Duke pro bono. The Georgia Supreme Court granted interlocutory review in this case to determine whether the trial court erred in determining whether Duke had neither a statutory right under the Indigent Defense Act of 2003, nor a constitutional right to state-funded experts and investigators needed to prepare a defense, notwithstanding private counsel as his representation. Contrary to the trial court’s conclusion, the Supreme Court found the IDA allowed an indigent defendant to obtain such ancillary defense services through a contract between pro bono counsel and either the Georgia Public Defender Council (“GPDC”) or the appropriate circuit public defender. Consequently, the Supreme Court reversed the judgment of the trial court in part, and remanded for further proceedings. View "Duke v. Georgia" on Justia Law

A trial court denied defendant-appellant Anthony Williams’s motion to substitute retained counsel for his appointed counsel. After the jury found Williams guilty of first degree murder, and found true a special allegation, the trial court sentenced him to life without the possibility of parole. On appeal, Williams claimed the trial court violated his constitutional right to counsel by denying his request to be represented by counsel of his choice and that this error requires reversal without regard to prejudice. To this, the Court of Appeal agreed, and reversed the trial court's judgment. View "California v. Williams" on Justia Law

Plaintiffs filed suit against the Oregon State Bar, alleging First Amendment violations arising from the Oregon State Bar's (OSB) requirement that lawyers must join and pay annual membership fees in order to practice in Oregon. Specifically, plaintiffs contend that (1) the two statements from the April 2018 Bulletin are not germane; (2) compelling them to join and maintain membership in OSB violates their right to freedom of association; and (3) compelling plaintiffs to pay—without their prior, affirmative consent—annual membership fees to OSB violates their right to freedom of speech. Furthermore, the Crowe Plaintiffs alone contend that the Bar's constitutionally mandated procedural safeguards for objecting members are deficient, and the Gruber Plaintiffs alone continue to argue on appeal that OSB is not entitled to sovereign immunity from suit. The district court dismissed all of plaintiffs' claims.The Ninth Circuit agreed with the district court that precedent forecloses the free speech claim, but neither the Supreme Court nor this court has resolved the free association claim now before the panel. Even assuming both statements at issue were nongermane, the panel concluded that plaintiffs' free speech claim failed. As alleged, the panel also concluded that the OSB's refund process is sufficient to minimize potential infringement on its members' constitutional rights. However, the panel explained that plaintiffs may have stated a viable claim that Oregon's compulsory Bar membership requirement violates their First Amendment right of free association. On remand, the panel noted that there are a number of complicated issues that the district court will need to address. First, the district court will need to determine whether Janus v. Am. Fed'n of State, Cnty., & Mun. Emps., Council 31, 138 S. Ct. 2448, 2477, 2481 (2018), supplies the appropriate standard for plaintiffs' free association claim and, if so, whether OSB can satisfy its "exacting scrutiny standard." Given that the panel has never addressed such a broad free association claim, the district court will also likely need to determine whether Keller v. State Bar of California's, 496 U.S. 1, 13–14 (1990), instructions with regards to germaneness and procedurally adequate safeguards are even relevant to the free association inquiry. Finally, the panel concluded that the district court erred by determining that OSB was an arm of the state entitled to Eleventh Amendment immunity. The Fourth Circuit vacated the district court's order denying plaintiff's motion seeking to recover reasonable attorney's fees, costs, and expenses from Montgomery County, Maryland. This case arose from the County's failure to reasonably accommodate plaintiff's disability. The district court concluded that plaintiff is not eligible for such an award because she was not a prevailing party under 29 U.S.C. 794a(b).The court found this case similar to Parham v. Southwestern Bell Telephone Co., 433 F.2d 421 (8th Cir. 1970), and concluded that plaintiff is even more of a prevailing party than the Parham plaintiff. The court explained that plaintiff is not a prevailing party because she catalyzed the County to change its behavior by filing a lawsuit; rather, she is a prevailing party because she proved her claim to a jury before the County capitulated by transferring her to another call center. Furthermore, the transfer was key to the district court's subsequent finding that the County reasonably accommodated plaintiff and thus the district court's ultimate denial of plaintiff's request for equitable relief. In 2016, Hill pleaded no contest to felony possession of a firearm by a convicted felon (case CR940896). The court suspended imposition of sentence and placed Hill on three years' felony probation. In 2019, a Clearlake police officer noticed Hill outside of a liquor store, approached, obtained Hill’s name, and conducted a records check, which revealed that Hill was on postrelease community supervision. As the officer returned, Hill “produced” a knife and placed it on a pole. Hill said he needed the knife “for protection” and that he had it shoved down his sleeve. Hill pleaded no contest to concealing a dirk or dagger (case CR953084) and admitted a probation violation in case CR940896. The plea was open with a maximum possible sentence of 32t months.The trial court revoked his probation in case CR940896 and sentenced Hill in both cases to an aggregate term of 32 months. The court of appeal affirmed, rejecting Hill’s argument that his attorney was ineffective for failing to request a hearing on his eligibility for mental health diversion under Penal Code section 1001.36. Because Hill’s appeal did not attack the validity of his plea but challenged the court’s sentencing discretion relating to section 1001.36, no certificate of probable cause was required. Hill's counsel was not deficient in failing to request an eligibility hearing nor was Hill prejudiced by counsel’s failure to do so. View "People v. Hill" on Justia Law

On remand from the Supreme Court, the Ninth Circuit reaffirmed the district court's order granting CFPB's petition to enforce the law firm's compliance with the Bureau's civil investigative demand (CID) requiring the firm to produce documents and answer interrogatories. The Supreme Court held that the statute establishing the CFPB violated the Constitution's separation of powers by placing leadership of the agency in the hands of a single Director who could be removed only for cause. The Court concluded, however, that the for-cause removal provision could be severed from the rest of the statute and thus did not require invalidation of the agency itself.The panel concluded that the CID was validly ratified, but the panel need not decide whether that occurred through the actions of Acting Director Mulvaney. After the Supreme Court's ruling, the CFPB's current Director expressly ratified the agency's earlier decisions to issue the civil investigative demand to the law firm, to deny the firm's request to modify or set aside the CID, and to file a petition requesting that the district court enforce the CID. The new Director knew that the President could remove her with or without cause, and nonetheless ratified the agency's issuance of the CID. Therefore, this ratification remedies any constitutional injury that the law firm may have suffered due to the manner in which the CFPB was originally structured. The panel explained that the law firm's only cognizable injury arose from the fact that the agency issued the CID and pursued its enforcement while headed by a Director who was improperly insulated from the President's removal authority. The panel concluded that any concerns that the law firm might have had about being subjected to investigation without adequate presidential oversight and control have now been resolved. Dat was born in a Kenyan refugee camp in 1993. Admitted to the U.S. around 1994, he became a lawful permanent resident. Dat pled guilty to robbery, 18 U.S.C. 1951, and was sentenced to 78 months' imprisonment. Dat’s robbery conviction is a deportable offense, 8 U.S.C. 1227(a)(2)(A)(iii). Dat moved to vacate his guilty plea, claiming that his attorney, Allen, assured him that his immigration status would not be affected by his plea. Allen testified that she repeatedly told Dat the charges were “deportable offenses,” that she never told him, his mother, or his fiancée that he would not be deported. that she encouraged Dat to hire an immigration attorney, and that they reviewed the Plea Petition, which says that non-citizens would be permanently removed from the U.S. if found guilty of most felony offenses. The Plea Agreement refers to immigration consequences. Dat and Allen also reviewed the PSR, which stated that immigration proceedings would commence after his release from custody.The Eighth Circuit affirmed the denial of relief, finding that Dat was not denied effective assistance of counsel. It was objectively reasonable for Allen to tell Dat that he “could” face immigration ramifications that “could” result in deportation. An alien with a deportable conviction may still seek “relief from removal. These “immigration law complexities” should caution any defense attorney not to advise a defendant considering a guilty plea that the result of a post-conviction, contested removal proceeding is certain. In September 2014, prior to the request for the records at issue in this case, the Abolitionist Law Center published a report which alleged a causal connection between the ill health of inmates at SCI-Fayette, and the facility’s proximity to a fly ash dumpsite. In response to the report, the Pennsylvania Department of Corrections (DOC) coordinated with the Department of Health (DOH) to investigate the allegations (the No Escape Investigation). Reporter Christine Haines of The Herald Standard (Appellees) sent an e-mail Right-to-Know-Law (RTKL) request to the DOC seeking documentation of inmate illnesses. The DOC denied Appellees' request in its entirety, citing several exceptions under Section 708(b) of the RTKL, as well as attorney-client privilege and deliberative process privilege grounds. Then in December 2014, in-house counsel for the DOC disclosed fifteen pages of records to Appellees. Appellees asked DOC to verify that its December disclosure was a complete response. Several additional records were subsequently released, but implicitly, the records released were the DOC's response. In February 2015, Appellees filed a petition for enforcement with the Commonwealth Court, seeking statutory sanctions and attorney fees alleging DOC demonstrated bad faith in responding to the request for records. The court identified records that the DOC should have provided. But because the panel could not discern the full extent of any non-compliance by DOC, the panel directed the parties to file a stipulation as to the disclosure status of court-identified five classes of records. Appellees' motion was thus denied without prejudice, and the court reserved judgment on the issue of bad faith sanctions. The Pennsylvania Supreme Court granted appeal in this matter to consider the assessment of sanctions and fees based on the Commonwealth Court's finding of bad faith and willful and wanton behavior. The Supreme Court ultimately affirmed, finding that Section 1304(a0(1) of the RTKL “permit[s] recovery of attorney fees when the receiving agency determination is reversed, and it deprived a requester of access to records in bad faith.” View "Uniontown Newspaper, et al v. The issue presented for the Colorado Supreme Court's review in this interlocutory appeal was whether the district court abused its discretion in disqualifying the Fifth Judicial District Attorney's office. The district attorney and the elected coroner of Lake County, Colorado, Shannon Kent, did not get along. Brown prosecuted Kent for perjury, a class 4 felony, and second degree official misconduct, a class 1 petty offense. After the case had been pending for approximately nine months, Kent filed a motion to disqualify Brown’s office, arguing that he was unlikely to receive a fair trial based on Brown’s personal interest in the case and the existence of special circumstances. Following briefing and an evidentiary hearing, the district court granted the motion. The trial court determined each special circumstance, “in and of itself,” did not warrant disqualification, but “viewed as a totality,” sufficed for the exceptional remedy sought by Kent. The Supreme Court determined the district attorney's office should not have been disqualified, finding the trial court failed to adequately explain how the circumstances in question, though individually inadequate to warrant disqualification, justified the extraordinary relief requested when considered together. "And the record before us reflects that Kent plainly failed to satisfy his burden of establishing that he would be unlikely to receive a fair trial if Brown’s office continues prosecuting this case. ... Even assuming the circumstances at issue 'may cast doubt' upon Brown’s 'motives and strategies' in this case, 'they do not play a part in whether [Kent] will receive a fair trial.'" View "Colorado v. The issue presented for the Colorado Supreme Court's review in this interlocutory appeal was whether the district court abused its discretion in disqualifying the Fourth Judicial District Attorney's office. Erica Arellano was charged with second degree murder for shooting and killing her boyfriend, M.H. Arellano claimed that, during the relationship, M.H. perpetrated domestic violence on her and that self-defense would be a critical issue and the crux of Arellano’s defense. A.H. was an employee of the district attorney’s office and was married to, but separated from, M.H. at the time of his death. A.H. was a potentially significant witness in this case because she had (and already provided to the district attorney’s office) information tending to undermine Arellano’s claim of self-defense. In light of A.H.’s relationship with the district attorney’s office and the significance of her testimony to this case, Arellano filed a motion to disqualify the district attorney’s office under section 20-1-107(2), C.R.S. (2020). The district court held a hearing on this motion and, in a lengthy and detailed bench ruling, found that, on the facts presented, special circumstances existed making it unlikely that Arellano could receive a fair trial. The court thus granted Arellano’s motion to disqualify. The State then filed this interlocutory appeal. The Supreme Court determined the district court did not abuse its discretion in disqualifying the district attorney's office, thus affirming the court's order and remanding this case for further proceedings.
