In 2016, a grand jury indicted defendant Fred Reimonenq on charges of first degree rape, attempted first degree rape, and sexual battery of a victim under the age of 13. Trial was scheduled to begin on September 25, 2018. On the Sunday before this trial date, the state presented defense counsel with a curriculum vitae, but apparently nothing more, of Anne Troy, Ph.D., a sexual assault nurse examiner, who it intended to call as an expert witness at trial. On the morning of trial, the state provided defense counsel with formal notice of its intent to use Dr. Troy’s testimony. Defendant filed a motion in limine to exclude any expert testimony that had not been properly noticed under La.C.Cr.P. art. 719, including Dr. Troy’s testimony. The trial court granted the defense’s motion in limine and excluded Dr. Troy’s testimony. The court disallowed any attempt at supplementation based upon its finding there was “a timing issue” that still made the late notice “prejudicial to the [d]efense and [did] not afford the [d]efense the opportunity to conduct whatever defensive positions it might otherwise be able to take had it had more time . . . .” The state noted its intent to apply for supervisory writs, but did not do so, and, instead, opted to enter a nolle prosequi. Two days later, on September 27, 2018, the state filed a new indictment on the same charges. On October 18, defendant appeared for arraignment and orally moved to adopt all previous filings and motions from the original case. Trial was then set for December 3, 2018. On November 27, 2018, the state filed its supplemental notice pursuant to La.C.Cr.P. art. 719 with respect to Dr. Troy’s testimony. On the morning of trial, defense counsel filed a supplemental motion in limine regarding Dr. Troy’s testimony and a related motion to quash. The issue this case presented for the Louisiana Supreme Court's review centered on the authority of the district attorney to dismiss and reinstitute criminal prosecutions. Because the actions of the state in this matter "so undermine the authority of the trial court that it offends bedrock principles of fundamental fairness and due process," the Court reversed. After plaintiff, an attorney, discovered that SBAND was using his compulsory dues to oppose a state ballot measure he supported, plaintiff filed suit against SBAND and various state officials in their official capacities, alleging First Amendment claims. The district court granted summary judgment for defendants and the Eighth Circuit affirmed. A year later, the Supreme Court issued its decision in Janus v. American Federation of State, County, and Municipal Employees, 138 S. Ct. 2448 (2018).On remand from the Supreme Court, the Eighth Circuit again affirmed the district court's judgment and held that Janus did not alter its prior decision explaining why the district court did not err in granting summary judgment dismissing plaintiff's claim that SBAND's procedures violate his right to "affirmatively consent" before subsidizing non-germane expenditures. The court held that plaintiff forfeited his claim that mandatory state bar association membership violates the First Amendment by compelling him to pay dues and to associate with an organization that engages in political or ideological activities; SBAND's revised fee statement and procedures clearly do not force members to pay non-chargeable dues over their objection; nothing in the summary judgment record suggests that SBAND's revised fee statement is so confusing that it fails to give SBAND members adequate notice of their constitutional right to take the Keller deduction. The Fifth Circuit held that the magistrate judge's dual role—generator and administrator of court fees—creates a conflict of interest when the judge sets an arrestee's bail, and therefore violates due process. Like the mayor in Ward v. Monroeville, the court held that because a magistrate judge must manage his chambers to perform the judicial tasks the voters elected him to do, he has a direct and personal interest in the fiscal health of the public institution that benefits from the fees his court generates and that he also helps allocate. Furthermore, the bond fees impact the bottom line of the court to a similar degree that the fines did in Ward. Accordingly, the court affirmed the district court's determination that the magistrate judge's institutional incentives create a substantial and unconstitutional conflict of interest when he determines the class's ability to pay bail and sets the amount of that bail. The Fifth Circuit affirmed the district court's grant of summary judgment for plaintiffs in an action against Judges of the Orleans Parish Criminal District Court under 42 U.S.C. 1983, alleging that the Judges' practices in collecting criminal fines and fees violated the Due Process Clause of the Fourteenth Amendment.The court agreed and held that the district court did not err in applying the principles from Tumey v. State of Ohio, which held that officers acting in a judicial or quasi judicial capacity are disqualified by their interest in the controversy to be decided, and Ward v. Vill. of Monroeville, which presented a situation in which an official perforce occupies two inconsistent positions and necessarily involves a lack of due process of law in the trial of defendants charged with crimes before him. In this case, the Judges have exclusive authority over how the Judicial Expense Fund is spent, they must account for the OPCDC budget to the New Orleans City Council and New Orleans Mayor, and the fines and fees make up a significant portion of their annual budget. Doe sued the University for violating his due-process rights during a disciplinary hearing. The Sixth Circuit remanded Doe’s case in light of a related ruling requiring live hearings and cross-examination in such proceedings. Upon remand, the district judge, frustrated with the University’s apparent foot-dragging, scheduled a settlement conference and required the University’s president to attend. The University requested that the president be allowed to attend by telephone but the district judge refused. The University then requested permission to send someone with both more knowledge about the sexual assault policy at issue and full settlement authority. The judge again refused, stating he wanted the president to be there even if someone else with full settlement authority attended, and “even if the parties [we]re able to resolve" the issue. The University planned for the president to attend. Two days before the settlement conference, the district judge decided that the conference (which he had assured the University would be private) should be a public event, stating that “the University’s public filing of a Motion to Dismiss . . . . The filing incited confusion amongst the media.” The Sixth Circuit issued a writ of mandamus, finding that the district judge acted beyond his power and abused his discretion. The parties dispute the district court's award of attorney's fees to plaintiff in an action successfully claiming a violation of the Religious Land Use and Institutionalized Persons Act. The Second Circuit affirmed and held that plaintiff was entitled to attorney's fees as a prevailing party; plaintiff may not obtain fees for the administrative proceedings for failure to identify "the discrete portion of the work product from the administrative proceedings" for which fees might have been awarded, North Carolina Dep't of Transportation v. The Eighth Circuit affirmed the district court's dismissal of TJN's 42 U.S.C. 1983 action against defendants, in an action arising from the Craighead County District Judges Boling and Fowler's implementation of an Amnesty Program forgiving all fees that probationers owed to TJN for probation services. The court held that Judges Boling and Fowler were entitled to absolute judicial immunity against all of TJN's claims, because Arkansas judges have authority to suspend the imposition of fines in criminal cases and may modify terms and conditions of supervision. Furthermore, TJN's request for declaratory relief was retrospective and thus it was not entitled to such relief under section 1983. The court also rejected the municipal liability claims and held that the judges are state government officials whose actions are not attributable to the county or city defendants. A 2004 Ohio statute regulated the "off-label" prescription of mifepristone (RU-486), which is commonly used in conjunction with misoprostol, to induce first-trimester abortions without surgery. Planned Parenthood challenged the statute under 42 U.S.C. 1983. The Sixth Circuit affirmed a preliminary injunction “insofar as it prohibits unconstitutional applications of the [statute].” In 2006, the district court entered a permanent injunction. After the Ohio Supreme Court answered certified questions, the Sixth Circuit remanded for a determination regarding the injunction’s scope. In 2011, the district court clarified that the statute was enjoined only as it applied to instances where the health of the patient was at risk and denied broader relief, leaving one remaining claim. In 2016, the FDA amended its approval and label for mifepristone, authorizing the off-label uses at issue. The statute remains in force, requiring physicians to prescribe medication abortion according to the FDA’s updated approval. Planned Parenthood sought $10,365.35 to cover costs for litigation on the merits and attorneys’ fees at 2016 rates to offset lost interest. Using this rate, the requested fees for the preliminary injunction litigation totaled $372,164.63. The district court granted that request, finding the requested hours and rates reasonable. The Sixth Circuit affirmed, rejecting arguments that Planned Parenthood does not properly qualify as a “prevailing party” because its relief was narrow and preliminary; that the court erred in refusing to apply a blanket fee reduction based on the degree of success; and that the court erred in applying 2016 rates rather than 2006 rates The court properly engaged in a contextual, case-specific review, considered the aims of section 1988, and adequately explained its rationale. Ohio Revised Code 4123.88 addresses how workers' compensation claimant information is handled and protected by the Ohio Bureau of Workers’ Compensation and contains the solicitation ban at issue: “No person shall directly or indirectly solicit authority” (1) to “represent the claimant or employer in respect of” a worker’s compensation “claim or appeal,” or (2) “to take charge of” any such claim or appeal. The district court rejected Bevan's challenge on summary judgment. The Sixth Circuit reversed, concluding that the state has prohibited all solicitation, whether oral or written, by any person to represent a party with respect to an Ohio workers’ compensation claim or appeal and that such a prophylactic ban violates the First Amendment under the Supreme Court’s 1988 "Shapero" decision. The court rejected an argument that the constitutionally questionable language is part of a larger statutory scheme that Bevan allegedly violated by obtaining claimant information from the Bureau in an unlawful manner. Whether Bevan violated other statutory provisions governing disclosure of claimant information is not relevant to whether the solicitation ban itself is constitutional. The solicitation ban makes no distinction as to how the person doing the soliciting learned of the claimant’s information: it bans all solicitation regardless of where or how that information was obtained. This case presented for the Georgia Supreme Court’s review an issue of first impression: the effects of the General Assembly’s wholesale revision in 2016 of the anti-SLAPP statute, OCGA 9-11-11.1, which substantially mirrored California Code of Civil Procedure 425.16. LTC Consulting, L.P. and two affiliated entities sued law firm Wilkes & McHugh, P.A. and one of its attorneys for violations of OCGA 31-7-3.2 (j), deceptive trade practices, and false advertising after the defendants ran full-page advertisements in local newspapers targeting patients of nursing homes owned by the plaintiffs. The defendants filed a Motion to Dismiss or to Strike Pursuant to OCGA sections 9-11-11.1 and 9-11-12 (b) (6), arguing among other things that OCGA 31-7-3.2 (j), enacted in 2015, violated the First Amendment. The motion was filed the day before a previously scheduled injunction hearing, but the trial court considered the defendants’ motion and denied it. The defendants appealed to the Court of Appeals, which transferred the case to the Georgia Supreme Court. The Supreme Court concluded the defendants met their burden under OCGA 9-11-11.1 to show that the plaintiffs’ claims were ones arising from acts that could reasonably be construed as acts in furtherance of the defendants’ right of free speech under the United States Constitution in connection with an issue of public interest or concern, thereby triggering the application of OCGA 9-11-11.1. The burden then shifted to the plaintiffs to establish that there was a probability that they would prevail on their claims. However, in analyzing these claims, the parties did not argue, and the trial court did not properly apply, the new standards for anti-SLAPP motions.
