The Supreme Court affirmed the decision of the circuit court denying Defendant's motion to withdraw his guilty plea, holding that the disciplining of Defendant's attorney for professional misconduct that included his handling of Defendant's defense did not prove that counsel had provided ineffective assistance.Defendant pleaded guilty to a single count of armed robbery as a party to a crime. Before sentencing, Defendant asked to withdraw his plea due to ineffective assistance of counsel. The circuit court denied the motion. While Defendant's appeal was pending, the Supreme Court decided a disciplinary case brought against Defendant's counsel and disciplined the attorney for professional misconduct. On appeal, Defendant argued that his attorney's discipline for his misconduct in handling Defendant's defense is proof to establish the deficiency of his counsel. The Supreme Court disagreed, holding that the record did not demonstrate that the professional misconduct of Defendant's attorney prevented Defendant from receiving effective assistance of counsel, and therefore, the circuit court did not erroneously exercise its discretion in denying Defendant's motion. The State of Alabama petitioned the Alabama Supreme Court for a mandamus relief. The State sought the vacation of a circuit court order holding certain statutes and acts of Alabama unconstitutional, and to require the Mobile circuit clerk to withhold 10% of the funds collected as court costs and fees from litigants in Mobile County until such time the State adequately funds the clerk’s office. This matter arose out of a criminal proceeding in which a grand jury indicted Mandy Brady for trafficking methamphetamine. Brady posted bond on that charge and was released; however, she was subsequently arrested on a new charge, and the State moved to revoke her bond. The circuit court granted the State's motion and revoked Brady's bond. Despite the fact that Brady was in State custody when the circuit court revoked the bond, Brady did not appear at her scheduled trial on the trafficking charge. When Brady failed to appear, the circuit court issued a show-cause order to the circuit clerk, the Mobile County sheriff, "and/or" the warden of the Mobile County jail seeking an explanation as to why Brady was released from jail despite the fact that the circuit court had revoked her bond. The warden testified that he never received notice from the circuit clerk's office that Brady's bond had been revoked; the circuit clerk testified that an employee in her office had properly entered the circuit court's order revoking Brady's bond before Brady was released from the county jail but that employee apparently failed to send notice of the order to the county jail. The circuit clerk explained that this mistake occurred because she did not have the ability to fully train her employees before giving them the responsibility of managing a circuit judge's docket; ultimately the problem, according to the circuit clerk, was that she did not have adequate funding to retain well trained personnel. The Supreme Court determined the circuit court exceeded its authority in the Brady matter, “purporting to award declaratory and injunctive relief no party had requested.” The State’s petition for mandamus relief was granted. CAI filed suit against state prosecutors, seeking to enjoin the enforcement of state unauthorized practice of law (UPL) statutes against it. The Fourth Circuit affirmed the district court's grant of summary judgment to defendants, holding that the UPL statutes did not unconstitutionally restrict CAI's associational rights. In this case, like the solicitation statute in Ohralik v. Ohio State Bar Ass'n, 436 U.S. 447 (1978), North Carolina's UPL statutes only marginally affected First Amendment concerns and did not substantially impair the associational rights of CAI.The court also held that the UPL statutes did not unlawfully burden CAI's freedom of speech. Determining that intermediate scrutiny was the appropriate standard for reviewing conduct regulations that incidentally impact speech, the court held that barring corporations from practicing law was sufficiently drawn to protect clients. The court also held that the UPL statutes did not deny CAI due process, were not unconstitutionally vague, and did not violate the state constitution's Monopoly Clause. Finally, CAI's commercial speech claim was not an independent basis for granting relief and the state may forbid CAI from advertising legal services barred by law. The Fourth Circuit reversed the district court's order denying Citizens' motion for attorney's fees, expert fees, and costs stemming from a 42 U.S.C. 1983 action that successfully challenged a 2015 state law that redrew Greensboro City Council districts. The court held that civil rights fee-shifting statutes, such as those at issue here, are not meant to punish defendants for a lack of innocence or good faith but rather to "compensate civil rights attorneys who bring civil rights cases and win them." The court explained that "innocence" or a "lack of responsibility" for the enactment of an unconstitutional law was therefore not an appropriate criterion to justify denying a fee award against the party responsible for and enjoined from enforcing the unconstitutional law. The Fifth Circuit vacated the district court's denial of attorneys' fees in plaintiff's action under the Americans with Disabilities Act (ADA). Although the district court correctly determined that Farrar v. Hobby, 506 U.S. 103 (1992), provided the relevant legal framework in this case, the court held that the district court was in the best position to determine whether this lawsuit achieved a compensable public goal justifying a fee award. Plaintiff argued that this was an unusual case justifying a fee award because the litigation secured an ASL interpreter for Nelson Arce, achieved recognition of the rights of deaf probationers and prisoners to disability accommodations, deterred future ADA violations, and prompted necessary reforms in the defendants' policies toward deaf individuals. In 2008, Defendant was charged with the sexual assault of his 10-year-old daughter, J.G. The indictment alleged that defendant inserted his fingers in J.G.’s vagina, licked her vagina, and touched her buttocks. After his conviction, Defendant filed multiple pro se collateral challenges to his convictions and at various times was represented by different attorneys. In 2015, Defendant filed a pro se motion seeking DNA testing under the Code of Criminal Procedure of 1963 (725 ILCS 5/116-3). The state argued that the controversy at trial was not whether another individual had committed the crime but whether the alleged assault occurred at all. At a hearing, Defendant appeared pro se but was accompanied by attorney Brodsky, who sought to file a Supreme Court Rule 13 limited scope appearance. The court denied Brodsky’s oral request, stating that allowing the motion would mean that attorney Caplan, Brodsky, and the defendant were all working on the case. Defendant later argued extensively in support of his DNA motion. Brodsky was not present. The appellate court vacated the denial of the motion, citing the U.S. Supreme Court’s "Powell: decision concerning a court's refusal to hear chosen counsel. The Illinois Supreme Court reversed, finding no “Powell” violation. A section 116-3 action is civil in nature and independent from any other collateral post-conviction action and Brodsky’s request failed completely to comply with the requirements of that rule. Adams, a resident and member of the State Bar of Delaware, wanted to be considered for a state judicial position. Following the announcement of several judicial vacancies, Adams considered applying but ultimately chose not to because the announcement required that the candidate be a Republican. Because Adams was neither a Republican nor a Democrat, he concluded that any application he submitted would be futile. Adams challenged the Delaware Constitution's provision that effectively limits service on state courts to members of the Democratic and Republican parties, citing Supreme Court precedent: A provision that limits a judicial candidate’s freedom to associate (or not to associate) with the political party of his choice is unconstitutional. The governor responded that because judges are policymakers, there are no constitutional restraints on his hiring decisions. The Third Circuit ruled in favor of Adams, concluding that judges are not policymakers because whatever decisions judges make in any given case relates to the case under review and not to partisan political interests. The portions of Delaware’s constitution that limit Adams’s ability to apply for a judicial position while associating with the political party of his choice violate his First Amendment rights. Plaintiffs brought medical malpractice claims in Ohio state court against a doctor who operated on them and against several hospitals where he worked. The plaintiffs allege that the judge presiding over their case, Judge Schweikert, and Chief Justice O’Connor of the Ohio Supreme Court were biased against their claims. In accordance with Ohio law, they filed affidavits of disqualification against Judge Schweikert, and requested that Chief Justice O’Connor recuse herself from deciding Judge Schweikert’s disqualification. They then requested that a federal court enjoin Chief Justice O’Connor from ruling on the affidavit of disqualification pertaining to Judge Schweikert and enjoin Judge Schweikert from taking any action in their cases before the affidavit of disqualification was ruled upon. The Sixth Circuit affirmed the dismissal of the claims. The Younger abstention doctrine applies. The ability of Ohio courts to determine when recusal of a judge or justice is appropriate and to administer the recusal decision process in accordance with state law operates “uniquely in furtherance of the state courts’ ability to perform their judicial functions.” View "Aaron v. In the published portion of the opinion, the Court of Appeal noted that effective January 1, 2019, Code of Civil Procedure section 998 will have no application to costs and attorney and expert witness fees in a Fair Employment and Housing Act (FEHA) action unless the lawsuit is found to be "frivolous, unreasonable, or groundless when brought, or the plaintiff continued to litigate after it clearly became so." In regard to the litigation that predated the application of the amended version of Government Code section 12965(b), the court held that section 998 does not apply to nonfrivolous FEHA actions and reversed the order awarding defendant costs and expert witness fees pursuant to that statute. The Supreme Court granted the writ of prohibition sought by Petitioner, the Honorable Margaret L. Workman, Chief Justice of the Supreme Court of Appeals of West Virginia, and halted the impeachment proceedings against her, holding that the prosecution of Petitioner for the allegations set forth in Article IV, Article VI, and Article XIV of the Articles of Impeachment was prohibited.Petitioner was impeached on three of the eleven Articles of Impeachment approved by the House of Delegates. Articles IV and VI alleged that Petitioner improperly authorized the overpayment of senior-status judges, and Article XIV included charges that Petitioner and three other justices failed to implement various administrative policies and procedures. Petitioner filed this proceeding to have the Articles of Impeachment against her dismissed, naming as Respondents the president and president pro tempore of the Senate, the clerk of the Senate, and the West Virginia Senate. The Supreme Court granted a writ of prohibition, holding (1) the prosecution of Petitioner for the allegations at issue violated the separation of powers doctrine; (2) Respondents lacked jurisdiction over the alleged violations in Articles IV and VI and lacked jurisdiction over the alleged violation in Article XIV as drafted; and (3) the failure to set forth findings of fact and to pass a resolution adopting the Articles of Impeachment violated due process principles.
