Doe sued the University for violating his due-process rights during a disciplinary hearing. The Sixth Circuit remanded Doe’s case in light of a related ruling requiring live hearings and cross-examination in such proceedings. Upon remand, the district judge, frustrated with the University’s apparent foot-dragging, scheduled a settlement conference and required the University’s president to attend. The University requested that the president be allowed to attend by telephone but the district judge refused. The University then requested permission to send someone with both more knowledge about the sexual assault policy at issue and full settlement authority. The judge again refused, stating he wanted the president to be there even if someone else with full settlement authority attended, and “even if the parties [we]re able to resolve" the issue. The University planned for the president to attend. Two days before the settlement conference, the district judge decided that the conference (which he had assured the University would be private) should be a public event, stating that “the University’s public filing of a Motion to Dismiss . . . . The filing incited confusion amongst the media.” The Sixth Circuit issued a writ of mandamus, finding that the district judge acted beyond his power and abused his discretion. The parties dispute the district court's award of attorney's fees to plaintiff in an action successfully claiming a violation of the Religious Land Use and Institutionalized Persons Act. The Second Circuit affirmed and held that plaintiff was entitled to attorney's fees as a prevailing party; plaintiff may not obtain fees for the administrative proceedings for failure to identify "the discrete portion of the work product from the administrative proceedings" for which fees might have been awarded, North Carolina Dep't of Transportation v. The Eighth Circuit affirmed the district court's dismissal of TJN's 42 U.S.C. 1983 action against defendants, in an action arising from the Craighead County District Judges Boling and Fowler's implementation of an Amnesty Program forgiving all fees that probationers owed to TJN for probation services. The court held that Judges Boling and Fowler were entitled to absolute judicial immunity against all of TJN's claims, because Arkansas judges have authority to suspend the imposition of fines in criminal cases and may modify terms and conditions of supervision. Furthermore, TJN's request for declaratory relief was retrospective and thus it was not entitled to such relief under section 1983. The court also rejected the municipal liability claims and held that the judges are state government officials whose actions are not attributable to the county or city defendants. A 2004 Ohio statute regulated the "off-label" prescription of mifepristone (RU-486), which is commonly used in conjunction with misoprostol, to induce first-trimester abortions without surgery. Planned Parenthood challenged the statute under 42 U.S.C. 1983. The Sixth Circuit affirmed a preliminary injunction “insofar as it prohibits unconstitutional applications of the [statute].” In 2006, the district court entered a permanent injunction. After the Ohio Supreme Court answered certified questions, the Sixth Circuit remanded for a determination regarding the injunction’s scope. In 2011, the district court clarified that the statute was enjoined only as it applied to instances where the health of the patient was at risk and denied broader relief, leaving one remaining claim. In 2016, the FDA amended its approval and label for mifepristone, authorizing the off-label uses at issue. The statute remains in force, requiring physicians to prescribe medication abortion according to the FDA’s updated approval. Planned Parenthood sought $10,365.35 to cover costs for litigation on the merits and attorneys’ fees at 2016 rates to offset lost interest. Using this rate, the requested fees for the preliminary injunction litigation totaled $372,164.63. The district court granted that request, finding the requested hours and rates reasonable. The Sixth Circuit affirmed, rejecting arguments that Planned Parenthood does not properly qualify as a “prevailing party” because its relief was narrow and preliminary; that the court erred in refusing to apply a blanket fee reduction based on the degree of success; and that the court erred in applying 2016 rates rather than 2006 rates The court properly engaged in a contextual, case-specific review, considered the aims of section 1988, and adequately explained its rationale. Ohio Revised Code 4123.88 addresses how workers' compensation claimant information is handled and protected by the Ohio Bureau of Workers’ Compensation and contains the solicitation ban at issue: “No person shall directly or indirectly solicit authority” (1) to “represent the claimant or employer in respect of” a worker’s compensation “claim or appeal,” or (2) “to take charge of” any such claim or appeal. The district court rejected Bevan's challenge on summary judgment. The Sixth Circuit reversed, concluding that the state has prohibited all solicitation, whether oral or written, by any person to represent a party with respect to an Ohio workers’ compensation claim or appeal and that such a prophylactic ban violates the First Amendment under the Supreme Court’s 1988 "Shapero" decision. The court rejected an argument that the constitutionally questionable language is part of a larger statutory scheme that Bevan allegedly violated by obtaining claimant information from the Bureau in an unlawful manner. Whether Bevan violated other statutory provisions governing disclosure of claimant information is not relevant to whether the solicitation ban itself is constitutional. The solicitation ban makes no distinction as to how the person doing the soliciting learned of the claimant’s information: it bans all solicitation regardless of where or how that information was obtained. This case presented for the Georgia Supreme Court’s review an issue of first impression: the effects of the General Assembly’s wholesale revision in 2016 of the anti-SLAPP statute, OCGA 9-11-11.1, which substantially mirrored California Code of Civil Procedure 425.16. LTC Consulting, L.P. and two affiliated entities sued law firm Wilkes & McHugh, P.A. and one of its attorneys for violations of OCGA 31-7-3.2 (j), deceptive trade practices, and false advertising after the defendants ran full-page advertisements in local newspapers targeting patients of nursing homes owned by the plaintiffs. The defendants filed a Motion to Dismiss or to Strike Pursuant to OCGA sections 9-11-11.1 and 9-11-12 (b) (6), arguing among other things that OCGA 31-7-3.2 (j), enacted in 2015, violated the First Amendment. The motion was filed the day before a previously scheduled injunction hearing, but the trial court considered the defendants’ motion and denied it. The defendants appealed to the Court of Appeals, which transferred the case to the Georgia Supreme Court. The Supreme Court concluded the defendants met their burden under OCGA 9-11-11.1 to show that the plaintiffs’ claims were ones arising from acts that could reasonably be construed as acts in furtherance of the defendants’ right of free speech under the United States Constitution in connection with an issue of public interest or concern, thereby triggering the application of OCGA 9-11-11.1. The burden then shifted to the plaintiffs to establish that there was a probability that they would prevail on their claims. However, in analyzing these claims, the parties did not argue, and the trial court did not properly apply, the new standards for anti-SLAPP motions. Appellant Stephan Palmer, Sr. appealed the grant of summary judgment in favor of appellee, Attorney Mark Furlan. While incarcerated, appellant filed a petition for postconviction relief (PCR). Attorney Furlan, an ad hoc public defender, was assigned to represent appellant in the PCR proceedings. The petition was litigated until the parties agreed to settle, arriving at a proposed stipulation to modify appellant’s sentence. December 23, 2015 the PCR court granted the parties’ stipulation motion. The entry order was immediately emailed to the criminal division; the criminal division issued an amended mittimus to the Commissioner of Corrections the same day; and the following day, the Department of Corrections received the amended mittimus and recalculated appellant’s sentence in accord with the PCR court’s order amending the sentence. Appellant was released from incarceration on December 24. Appellant then filed a civil action against Attorney Furlan, alleging legal malpractice. Not knowing that immediate release was at stake, the PCR court took more time than it would have otherwise in scheduling a hearing and approving the stipulation. Appellant characterized the length of incarceration between when he posited he would have been released if Attorney Furlan had more aggressively attempted to get the PCR court to act in an expedited manner and when he was actually released as wrongful and the basis for his damages. In affirming summary judgment, the Vermont Supreme Court concluded "The proof provided here, or rather the lack thereof, leaves all reasonable minds to speculate as to whether or not the PCR court would have: not scheduled a hearing on the motion; scheduled a hearing on the motion sooner than it did; issued an order on the motion in a shorter period of time after the hearing; come to the same conclusions and granted the stipulation motion; or behaved in any of the seemingly endless alternative manners a reasonable person could posit. Appellant’s argument simply leaves too much to speculation, which is something this Court and trial courts will not do when examining a motion for summary judgment." View "Palmer v. The Supreme Court affirmed the decision of the circuit court denying Defendant's motion to withdraw his guilty plea, holding that the disciplining of Defendant's attorney for professional misconduct that included his handling of Defendant's defense did not prove that counsel had provided ineffective assistance.Defendant pleaded guilty to a single count of armed robbery as a party to a crime. Before sentencing, Defendant asked to withdraw his plea due to ineffective assistance of counsel. The circuit court denied the motion. While Defendant's appeal was pending, the Supreme Court decided a disciplinary case brought against Defendant's counsel and disciplined the attorney for professional misconduct. On appeal, Defendant argued that his attorney's discipline for his misconduct in handling Defendant's defense is proof to establish the deficiency of his counsel. The Supreme Court disagreed, holding that the record did not demonstrate that the professional misconduct of Defendant's attorney prevented Defendant from receiving effective assistance of counsel, and therefore, the circuit court did not erroneously exercise its discretion in denying Defendant's motion. The State of Alabama petitioned the Alabama Supreme Court for a mandamus relief. The State sought the vacation of a circuit court order holding certain statutes and acts of Alabama unconstitutional, and to require the Mobile circuit clerk to withhold 10% of the funds collected as court costs and fees from litigants in Mobile County until such time the State adequately funds the clerk’s office. This matter arose out of a criminal proceeding in which a grand jury indicted Mandy Brady for trafficking methamphetamine. Brady posted bond on that charge and was released; however, she was subsequently arrested on a new charge, and the State moved to revoke her bond. The circuit court granted the State's motion and revoked Brady's bond. Despite the fact that Brady was in State custody when the circuit court revoked the bond, Brady did not appear at her scheduled trial on the trafficking charge. When Brady failed to appear, the circuit court issued a show-cause order to the circuit clerk, the Mobile County sheriff, "and/or" the warden of the Mobile County jail seeking an explanation as to why Brady was released from jail despite the fact that the circuit court had revoked her bond. The warden testified that he never received notice from the circuit clerk's office that Brady's bond had been revoked; the circuit clerk testified that an employee in her office had properly entered the circuit court's order revoking Brady's bond before Brady was released from the county jail but that employee apparently failed to send notice of the order to the county jail. The circuit clerk explained that this mistake occurred because she did not have the ability to fully train her employees before giving them the responsibility of managing a circuit judge's docket; ultimately the problem, according to the circuit clerk, was that she did not have adequate funding to retain well trained personnel. The Supreme Court determined the circuit court exceeded its authority in the Brady matter, “purporting to award declaratory and injunctive relief no party had requested.” The State’s petition for mandamus relief was granted. CAI filed suit against state prosecutors, seeking to enjoin the enforcement of state unauthorized practice of law (UPL) statutes against it. The Fourth Circuit affirmed the district court's grant of summary judgment to defendants, holding that the UPL statutes did not unconstitutionally restrict CAI's associational rights. In this case, like the solicitation statute in Ohralik v. Ohio State Bar Ass'n, 436 U.S. 447 (1978), North Carolina's UPL statutes only marginally affected First Amendment concerns and did not substantially impair the associational rights of CAI.The court also held that the UPL statutes did not unlawfully burden CAI's freedom of speech. Determining that intermediate scrutiny was the appropriate standard for reviewing conduct regulations that incidentally impact speech, the court held that barring corporations from practicing law was sufficiently drawn to protect clients. The court also held that the UPL statutes did not deny CAI due process, were not unconstitutionally vague, and did not violate the state constitution's Monopoly Clause. Finally, CAI's commercial speech claim was not an independent basis for granting relief and the state may forbid CAI from advertising legal services barred by law.
